Military Divorce in Spokane

Special Rules Apply to Divorce During Military Service

When one or both of the divorcing spouses are members of the military, both state and federal laws apply to the situation. Military divorce can be more complicated, so you may want to seek advice from a military divorce lawyer in Spokane. At the Law Office of Benjamin D. Platt, we have represented many military members and their spouses in divorce and family law cases.

If you or your spouse belong to the military, call (509) 571-2277 for a consultation to learn how your divorce may be affected.

How Military Experience Affects Divorce

There is no minimum length of time for state residency in Washington to file for divorce. As long as at least one of the spouses is a resident of the state or a member of the military stationed in Washington, you meet the requirements to file for divorce in the state. Most assets are divided in the same manner, regardless of military service. However, an exception is disability pay, including compensation from the U.S. Department of Veterans Affairs.

Property and assets divided according to the state’s community property standards include:

  • Real estate
  • Income
  • Investments
  • Personal property
  • Military pensions

One important way divorce may be affected is when one spouse is deployed overseas. A provision in the Civil Relief Act allows a member of the military to postpone the divorce while he or she is overseas and unable to adequately respond. If the military member desires that the divorce go forward, he or she may waive this right.
