How Military Experience Affects Divorce

There is no minimum length of time for state residency in Washington to file for divorce. As long as at least one of the spouses is a resident of the state or a member of the military stationed in Washington, you meet the requirements to file for divorce in the state. Most assets are divided in the same manner, regardless of military service. However, an exception is disability pay, including compensation from the U.S. Department of Veterans Affairs.

One important way divorce may be affected is when one spouse is deployed overseas. A provision in the Civil Relief Act allows a member of the military to postpone the divorce while he or she is overseas and unable to adequately respond.
