When Washington Child Relocation Law Applies

The Washington Child Relocation Act is codified at RCW 26.09.405 through RCW 26.09.560. It governs relocation after a court-approved custody arrangement is in place. The applicable requirements depend in part on where the child lives most of the time and whether the new residence is inside or outside the child’s current school district.

A parent must provide notice of an intended relocation when the child resides with that parent a majority of the time or when the parents have substantially equal residential time. The notice goes to other people entitled to court-ordered time or visitation under the existing order.

Moves Within the District

A move within the district where the child currently resides most of the time may be communicated by reasonable means. A person entitled to residential time can’t object to an in-district move under the relocation chapter.

An in-district move can still create disputes about transportation, exchanges, school arrangements, or the practicality of the current schedule. Although the move itself isn’t subject to a relocation objection, a parent may seek a modification under RCW 26.09.260.

Notice for Moves Outside the District

A parent proposing to relocate the child outside the current school district must generally provide written notice at least 60 days before the intended move. It must be delivered by personal service or mail requiring a return receipt. These formal requirements differ from the reasonable notice permitted for an in-district move.

The written relocation notice must include:

• The proposed new address
• Available school or daycare information
• The intended relocation date
• The reasons for the proposed move
• A proposed revised schedule

Providing notice doesn’t automatically authorize an immediate change to the child’s residence. The relocating parent generally can’t change the child’s principal residence while another party is permitted to object unless the court enters an order. RCW 26.09.460 provides a safety exception, so circumstances involving a safety concern require careful review of the statute and the facts.

Objecting to Child Relocation in Spokane

A person entitled to object generally must file within 30 days after receiving the relocation notice. If no objection is filed during that period, the relocation is permitted unless good cause is shown. Because the deadline runs from receipt, retaining the notice and delivery materials can help establish when the response period began.

Filing an objection places the requested relocation before Spokane County Superior Court, which hears relocation and parenting disputes affecting Spokane families. The court applies the statutory standard rather than either parent’s preference alone.

The Presumption & Statutory Factors

Under RCW 26.09.520, a proposed relocation is presumed permitted. The objecting person must prove that the move’s detrimental effect outweighs its benefit to the child and the relocating person. That burden makes the facts concerning the child, both parents, and the proposed arrangements central to the dispute.

The court considers eleven statutory factors when deciding whether the objecting person has rebutted the presumption. The factors are unweighted, so the statute doesn’t direct the court to treat any one consideration as automatically more important than another.
